Article 1: Scope and modification of the general terms of sales
The following general terms of sales apply to any order placed on the website www.calibag.com. The applicable general terms of sales are those in force at the day of the validation of the order.
Article 2: Product avaibility
Our product and price offerings are available as long as they appear on the website.
Artcile 3: Order validation and electronic signature (law of 13 March 2000 about the electronic signature)
Any order form signed by the consumer by double clicking represents an irrevocable acceptance that can be contested only in the limits provided in the following general terms of sales. The double click combined with teh authentification and non-repudiation and protection of the integrity of messages is an electronic signature. This electronic signature as the same valus as a hand made signature.
Article 4: Methods of payment and securing
Methods of payment
By credit card: the payment is made through our bank, BNP paribas.
Your order is treated immediatly and made within 4 days.
By bank or postal check: your order is then reserved during 7 days loooking forward to the payment.
Beyond this deadline, without having received your check, it will be cancelled.
The order will be treated only after the receipt of your check and after validation.
By PayPal: to get this method of payment, you have to have an account near the company Paypal.
In case of PayPal payment, the general terms of use of paypal are applied.
You order is validated by Paypal and made as soon as this latter confirms.
Non-payment
Calibag company reserves the right to refuse to deliver or to fulfill an order issued by a consumer who would not have entirely or partially paid a previous order or one on which there is a settlement dispute pending.
Article 5: Sending and delivery
Deliveries only cover continental France, Corsica included.
Preparation of your order and transport of your parcel.
Your order is usually made within 4 days maximum after the receipt of your payment when all the products ordered do not have specific notes as for a longer period of preparation.
The standard method of sending is the delivery made by the company Exapaq home delivery offer.
Costs of delivery for continetal France through Exapaq: free
Costs of delivery for Corsica through Colissimo: free
For this sending method the delivery deadline is between 2 and 5 years.
We could not be held responsible for any data entry errors ans its consequences (for instance delays or delivery errors.
In this context, expenses incurred for the order forwarding would be your responsibility.
Article 6: Force majeure
Calibag will not be held responsible for breach of contract, due to the occurence of an event of force majeure.
As regards products purchased to satisfy professional needs, Calibag will not incur any responsibility for indirect damage due to this document, trading loss, loss of profit, damage or expenses which could occur.
Article 7: Retraction
Since all of our products are made, assembled and customized during your order, the articles L.121-20 and the next ones of the Consumer Code are not applied.
Actually, no right of withdrawal will be exercised after the sending of your order.
Article 8: Warranty, insurances and after-sales service
All of our products get a 1 year warranty from the delivery date on all the parts, then a 4 year warranty against breakage for the shell of your product.
The warrnty does not cover normal wear and tearn, indirect damage ans repairs made by unauthorized persons.
To get this warranty, you have to keep the product purchase invoice.
Article 9: Respect for intellectual property
You are personally responsible for the use of visuals (pictures, graphics, texts or other) that you include in your customized stickers. You are not allowed to use for your customized sticker any text, picture, draw, trademark or service mark or any work whose intellectual property rights belong to some third party without having obtained first the appropriate approvals from the owners.
You guarantee that your customized stickers will not infringe any right of a third party, including intellectual property right, registered trademark right, right to respect for private or public life and that they will not slander or defame a third party, and that you have all rights required or necessary permissions to incorporate products from a third party in your stickers.
Article 10: Provisions of the law "data processing and freedom"
At any time, "you can access, modify, correct and cancel some personal data (art 34 of the French law "informatiques et libertés" of the 6 January 1978).
You will be able to refuse to receive later the Calibag newsletter and its best deals that will be transmitted to you during your first order, clicking on the link located at the bottom of this newsletter or going on your personal pages of your Customer Service clicking on the link "Modifier mes préférences" (modificate my preferences). We also offer you to receive special offers from our partners.
For that, you just have to answer yes or no during your registration ticking the corresponding box at the following sentance: I wish receive the best offers from Calibag partners. Furthermore, you may receive special offers by SMS if you have registered the field "mobile phone" during your registration. You will be able to modificate these subscriptions clicking on the link located at the bottom of any Newsletter or going directly on your personal pages of your customer area.
